U.S. Judge Stephanie Rose dismissed charges against a Chinese woman, Mo Yun, accused of conspiring to steal trade secrets from U.S. seed companies, said the Associated Press. Prosecutors requested dismissal after the judge ruled that instant messages found on Mo’s brother’s computer could not be used against her. The brother, Mo Hailong, is now the only defendant facing trial, said the AP. Five other people accused in the case are believed to be in China and there is no extradition treaty. The government says Mo Hailong and other employees of a Chinese company stole seeds from Iowa cornfields and sent them overseas in a plan to replicate their traits. The thefts affected seed companies including Pioneer and Monsanto, according to the government.
